There is no Allen County Code provision aimed at residential smokers. A smoker used for cooking falls under the 8-20-4-1 exemption for 'fires for cookouts,' which are permitted without the open-burning distance limits. However, the countywide rule in 8-20-2-2 still applies: burning of wood products may not emit smoke 'in such quantities as to cause annoyance or to constitute a nuisance so as to interfere with the health or well being of any individual in his or her home.' A smoker that persistently fouls a neighbor's property could therefore draw a nuisance complaint even though smoking food itself is legal.
A smoker creating a persistent smoke nuisance can be cited under AC 8-20-2-2 (infraction, $25 fine; up to $2,500 if willful) or general nuisance law.
