Texas counties cannot zone, and the state outdoor-lighting authority for counties near observatories or military bases does not reach El Paso County, so the unincorporated county has no dark-sky order. Lighting on private property is largely unregulated outside city limits.
El Paso County imposes no dark-sky or exterior-lighting order on private property. Texas counties cannot require shielded fixtures or cap illumination the way a city can. The statute that lets some counties adopt outdoor-lighting orders, Local Government Code Section 240.032, reaches only counties within 57 miles of the McDonald Observatory, near the George or Stephen F. Austin observatories, or, for military bases, a county over one million population with at least five U.S. military bases. El Paso County meets none of these tests, so it has no dark-sky order despite hosting Fort Bliss. Health and Safety Code Chapter 425 covers mainly state-funded lighting near bases and observatories, not private yards.
Because the unincorporated county has no lighting order, there is no county penalty for bright or unshielded outdoor lighting; disputes are handled through private nuisance or light-trespass claims, or, inside a city, that city's lighting code, not county enforcement.
