This is a real county power. Under Texas Transportation Code Chapter 683, Brazoria County may declare a junked vehicle a public nuisance and remove it from private or public property, even in unincorporated areas, after required notice.
Unlike zoning, junked-vehicle abatement is expressly granted to counties by state law. A junked vehicle includes one that is self-propelled and wrecked, dismantled, or inoperable for more than 72 consecutive hours on public property or 30 consecutive days on private property (Transp. Code § 683.071). If visible from a public place, it is declared a public nuisance (§ 683.072). Section 683.074 authorizes a county to adopt abatement procedures and remove the vehicle. Owners receive written notice and an opportunity to respond before removal to a scrapyard or demolisher.
After required notice (generally at least 10 days), the county or city may remove and destroy the junked vehicle. Costs may be assessed to the owner; noncompliance is a nuisance offense.
