City of Newburgh regulates residential driveways through Chapter 300 (Zoning) Article IX (Off-Street Parking and Loading) and Chapter 288 (Parking, Standing and Stopping). Newburgh's driveway and residential parking rules are codified in two chapters of the City Code (on eCode360): Chapter 300 (Zoning), Article IX (Off-Street Parking and Loading), and Chapter 288 (Parking, Standing and Stopping). Important note: 'Newburgh' on the GSC URL is the City of Newburgh (incorporated city, pop. ~28,856); the surrounding Town of Newburgh is a separate municipality with its own code (covered elsewhere). Key City of Newburgh rules: (1) Driveway width at front lot line β any entrance or exit driveway for a residential use shall not exceed 20 feet nor be less than 12 feet in width at its intersection with the front lot line; (2) Driveway spacing β exits and entrances must be a minimum of 50 feet from any entrance/exit on the same side of the street, unless the Planning Board determines the distance may be reduced without impacting public safety; (3) Sensitive-use separation β driveways must be a minimum of 200 feet (measured along the side of the street) from any school, public playground, church, public library, hospital, or institution for dependents or children; (4) Front-yard parking β off-street parking in front of the building is permitted only with site plan approval from the Planning Board; all residential dwellings proposing front-yard parking must obtain site plan approval even if no significant construction is occurring; (5) Commercial vehicle restriction β commercial vehicles shall not be parked on private property within 100 feet of a residential dwelling, nor parked on any public road; (6) Off-street parking minimums β Article IX sets minimum parking ratios for each residential use (typically 1.5-2 spaces per dwelling unit). New York State VTL Β§1203 controls on-street parking distances from intersections, hydrants, and crosswalks.
Violations of Chapter 300 are enforced by the City Code Compliance Department through written notices and zoning-board appeals. Chapter 288 on-street violations are enforced by Newburgh PD with standard NY parking-ticket fines. Unpermitted front-yard parking pads, oversized driveways, and commercial-vehicle storage near residences are among the most cited issues. Persistent violations can be referred to the Corporation Counsel for injunctive action.
