Albuquerque enforces these provisions through the Planning Department and issues electrical permits for residential Level 2 (240V) charger installations; permits typically run $60-$120 and are processed within a few business days at the Plaza del Sol One Stop Shop. Bernalillo County uses the CID for unincorporated electrical permits. New Mexico has no EV-specific HOA preemption statute, but the Solar Rights Act (NMSA Β§47-3-4 et seq.) provides a model and HOAs generally may not unreasonably restrict reasonable accommodations. Public charging must meet ADA accessibility under the 2010 ADA Standards, and PNM and Public Service Company of New Mexico offer residential EV rate riders filed with the NM Public Regulation Commission.
Unpermitted 240V electrical work is a code violation subject to stop-work orders, re-inspection fees, and required correction. Non-compliant EV-ready provisions in new construction can block certificate of occupancy until remediated.
