The Uniform Fire Prevention and Building Code, adopted under Executive Law Article 18, sets electrical and fire safety standards for EV supply equipment that apply in every jurisdiction except New York City, which maintains an equivalent code. Public Service Law authorizes the Public Service Commission to regulate utility make-ready programs and charging tariffs. Energy Law Article 11 directs statewide adoption of the New York Stretch Energy Code, which addresses EV-ready parking requirements in new construction. Localities cannot weaken these technical safety and energy standards but may add zoning rules.
Installations that violate the Uniform Code can be denied a certificate of occupancy or be ordered corrected by code enforcement. Tampering with utility-owned charging infrastructure can trigger Public Service Law penalties and disconnection.
