The charger must be installed at the owner's expense, comply with applicable safety codes and manufacturer specifications, and be located in the owner's garage, designated parking space, or limited common area. HOAs may require the homeowner to carry liability insurance and to be responsible for damage. Texas also adopts the National Electrical Code through state and local building codes, governing the wiring and inspection of new EVSE installations.
HOAs that enforce void EV-charger bans can be sued; courts may award injunctive relief, actual damages, attorney's fees, and a civil penalty up to $1,000 per violation.
