Texas has no statewide facial recognition ban. Dallas County has not enacted any county prohibition on government or private facial recognition use. Dallas County Sheriff and DPD use various biometric tools subject to internal policy.
Unlike San Francisco, Boston, or Portland, no Texas city or county has enacted a facial recognition technology ban. Texas Business and Commerce Code Chapter 503 (Capture or Use of Biometric Identifier) regulates commercial collection of biometric identifiers including facial geometry, requiring consent and limiting retention, but exempts government use. Dallas County Sheriff, Dallas Police Department, and other county agencies may use facial recognition tools through state and federal partnerships. There is no Dallas County ordinance banning, regulating, or requiring disclosure of facial recognition by county departments. Civil liberties advocates have proposed limits but none have passed. Federal constitutional limits apply.
No prohibition exists. Commercial misuse of biometric data: TX Business and Commerce Code 503 civil penalties up to $25,000 per violation by attorney general.
