Unlike San Francisco, Boston, or Portland, no Texas city or county has enacted a facial recognition technology ban. Texas Business and Commerce Code Chapter 503 (Capture or Use of Biometric Identifier) regulates commercial collection of biometric identifiers including facial geometry, requiring consent and limiting retention, but exempts government use. Dallas County Sheriff, Dallas Police Department, and other county agencies may use facial recognition tools through state and federal partnerships. There is no Dallas County ordinance banning, regulating, or requiring disclosure of facial recognition by county departments. Civil liberties advocates have proposed limits but none have passed. Federal constitutional limits apply.
