Philadelphia's Zoning Code §14-706 regulates fence heights and opacity. Privacy fences (100% opaque) are allowed up to 6 feet along side and rear property lines. In front yards, fences are limited to 4 feet and maximum 50% opacity. Non-masonry fences over 6 feet require a building permit.
Philadelphia Zoning Code Section 14-706 governs fences and walls throughout the city. Along property street frontages and on side property lines forward of the front wall of the house, fences may be a maximum of 4 feet in height and must be no more than 50% opaque. At side property lines from the front wall of the house back, and along the back property line, fences may be up to 6 feet in height and can be 100% opaque (solid privacy fences). Non-masonry fences exceeding 6 feet require a building permit from L&I, with a fee of $110. Masonry fences (brick, stone, concrete) over 2 feet require a building permit. Existing non-compliant fences are NOT grandfathered—when replacing a non-compliant fence, property owners must install a compliant fence or obtain a Zoning Variance from the Zoning Board of Adjustment. Corner properties have additional visibility triangle requirements to maintain sight lines for traffic safety.
Non-compliant fences result in zoning violations from L&I. Fines vary per Philadelphia Code §1-109. Property owners may be required to remove or modify non-compliant fences. Zoning variances are available through the Zoning Board of Adjustment.
