Under Philadelphia Code Section 10-403(1), no person may create sound exceeding 3 decibels above background measured at the property boundary of any hospital, nursing home, house of worship, courthouse, school, library, or day care facility - and this protected-facility standard controls even where a less restrictive limit would otherwise apply. Section 10-403(3) limits sound from non-residential property (such as a bar, club, or business with amplified music) to 5 decibels above background at the nearest occupied residential boundary or 10 decibels above background at the nearest non-residential boundary. Section 10-403(5) caps total sound from a concert venue (seating capacity over 1,000) or stadium at 70 decibels measured at the nearest occupied residential property boundary. Amplified radios or players in the right-of-way near homes are barred 9 p.m. to 8 a.m. under Section 10-403(7)(a), and amplified devices on public transit must be used with earphones under Section 10-403(9). Code Violation Notices and escalating fines apply under Section 10-406, from $100-$300 (first) up to $500-$700 (fourth or later) within twelve months, with each day treated as a separate violation.
