Garage sales are allowed by right in every zoning district in unincorporated Boulder County. A garage or occasional sale may occur no more than four times a year, for no more than three days each. You cannot buy merchandise just to resell it at the sale.
The Boulder County Land Use Code added a 'garage or occasional sale' use (effective 2004), defined as the sale of tangible personal property at retail by a person who is not in the business of selling. Such sales are permitted by right in all districts within unincorporated Boulder County, so no special permit is normally required. The limits are frequency-based: no more than four sales per year, each lasting no more than three days. A person may not sell merchandise acquired solely for the purpose of resale at a garage or occasional sale. Cities and towns set their own garage-sale rules within their borders.
Exceeding the four-per-year or three-day-per-sale limits, or reselling goods bought for resale, converts the activity into a retail/commercial use requiring proper zoning approval and may be cited as a land-use violation.
