Chapel Hill does not require a Town permit or license for a residential garage / yard sale of personal household items. Sales must remain occasional residential uses; recurring or commercial-scale sales would trigger home-occupation review under LUMO. Yard-sale signs on the host's own property are exempt from the sign permit under LUMO 5.14.3, but off-premise signs and signs in the Town-maintained right-of-way are prohibited. Orange County does not impose a separate residential garage-sale permit. HOA covenants may impose private restrictions.
Chapel Hill has no dedicated garage-sale ordinance. (1) Permit: The Town's Business and Event Permits page does not list a residential yard-sale or garage-sale permit. Occasional residential sales of personal household items by the property owner are not 'businesses' for purposes of the Town's privilege licensing or zoning permits, and Chapel Hill does not require an event permit for them. (2) Frequency: The Town Code does not impose a per-year cap on residential garage sales, but if sales become recurring or commercial in scale, a home-occupation review may be triggered under LUMO (Appendix A — Article 3 Use Regulations and home-occupation standards). (3) Signs: LUMO Sec. 5.14.3 expressly exempts temporary 'yard sale' signs from the sign permit, alongside real estate, construction, political, public event, and grand opening signs. The exemption applies to signs on the host's own property; off-premise directional signs and signs placed in the Town-maintained public right-of-way (utility poles, tree-lawn, sign poles) are not exempt and may be removed by Town staff. (4) Parking: Garage-sale traffic must not block fire lanes, fire hydrants, or create a traffic hazard, per Town parking ordinances. (5) Sales tax: The North Carolina Department of Revenue treats casual occasional sales of personal household items by an individual as exempt from sales tax under the casual-sales rule (NCGS 105-164.13(31a) and longstanding NCDOR guidance), provided the seller is not engaged in the business of selling. (6) Orange County does not impose a separate local garage-sale permit. (7) HOAs: Many Chapel Hill subdivisions impose private CC&R rules on yard sales (frequency, hours, signage); these are enforced privately under NCGS Chapter 47F. Code Enforcement: codeenforcement@townofchapelhill.org or 919-969-5043.
Recurring or large-scale sales without home-occupation approval may be cited under LUMO Article 3 / 5. Off-premise or right-of-way yard-sale signs may be removed by Town staff under LUMO 5.14. HOA violations are private civil matters under NCGS Ch. 47F. General Town Code violations can carry civil penalties under standard NC municipal authority (typically up to $500/day, each day a separate offense).
