Brookhaven Town Code Chapter 57A permits 4 garage sales per year per household, each lasting no more than 3 consecutive days, with free permit from the Town Clerk. Islip Town Code Chapter 46 allows 3 sales per year, 2 consecutive days each. Southampton permits 2 per year. Sales must occur on the residence property only, not on public rights of way. Signs advertising sales are regulated separately (see Signs/garage-sale-signs). HOAs and condominiums often impose stricter limits. Items sold must be household personal property of the resident, not commercial inventory.
Exceeding allowed sales per year: 100-500 dollars. Operating without permit: 50-250 dollars. Commercial-scale sales: cease and desist plus 1,000 dollars per Ch 57A-5.
