The Town of Babylon Code (Chapter 168, Peddling and Soliciting, and related property standards in Chapter 152, Property Maintenance) treats occasional residential yard sales as a permitted accessory use in residential zoning districts, not as commercial activity. Residents may hold up to four garage, yard, or tag sales per household per calendar year, each lasting no more than three consecutive days during daylight hours (sunrise to sunset). Sales must be conducted on the resident's own property and may not spill onto public sidewalks, rights-of-way, or neighboring lots. Signs advertising the sale are regulated separately under the Town sign code (Chapter 213) and must not be affixed to utility poles, trees, or traffic control devices. Sales of new merchandise, regularly scheduled estate-clearing services, and sales held more than four times per year may be classified as an unlicensed business and subject to cease-and-desist orders.
Written notice of violation issued first; continued non-compliance can trigger fines up to $250 per offense under Chapter 203 (General Penalties). Operating as an unlicensed business is a separate violation.
