Washington County directly polices blight in unincorporated areas. Ark. Code 14-14-813 lets the county order owners to abate garbage, rubbish, junk, and unsanitary conditions, then abate them itself and lien the cost if ignored.
This is where county authority is strongest. Ark. Code 14-14-813 empowers the quorum court to order a property owner to abate, remove, or eliminate garbage, rubbish, and junk as defined in the state litter law, along with other unsightly and unsanitary articles, and to clear stagnant water that breeds mosquitoes. The order is posted on the property and mailed or published to the owner. If nothing is done within 30 days, the county can take corrective action itself and recover the cost. The law exempts land actively being farmed and parcels over 10 acres where the condition is not visible from a public road.
After a posted 30-day order, the county may abate the junk or unsanitary condition itself and, under Ark. Code 14-14-813, holds a lien against the property for the unpaid cost plus interest.
