Beyond placement timing rules, Chapter 51 requires that waste containers be screened from the public right-of-way when not at the curb for collection. Acceptable screening includes opaque fences at least as tall as the container, dense landscaping, enclosed garage storage, or placement in a side yard behind a front-yard setback line. Lids must be kept closed. Damaged containers should be reported to Waste Management for replacement. HOAs in planned communities like Polo Club or Mizner Country Club may impose stricter visual screening requirements than city code.
First offense typically results in a courtesy notice. Continued violations go to Code Enforcement Board hearings with fines up to 250 dollars per day plus potential liens.
