Because Texas counties have no general ordinance power, El Paso County does not regulate how unincorporated residents store garbage cans or the size, color, or screening of bins. Households that subscribe to a private hauler such as El Paso Disposal follow that company's cart and set-out rules. The only county backstop is the public-nuisance statute: Tex. Health & Safety Code Sec. 343.011(c) treats refuse not contained in a closed receptacle, or rubbish accumulated within 300 feet of a public street for 10 days or more, as a public nuisance. So while there is no bin ordinance, refuse left loose or scattered can still trigger the Chapter 343 abatement process. Inside cities, that city's container rules apply instead.
There is no citation for bin type or placement. But refuse in open containers or scattered rubbish can be a public nuisance under Sec. 343.011, abated by the 31st day (10th business day for repeats) before a lien.
