Under the Lee County Mandatory Solid Waste ordinance (Ord. 11-03 as amended by 11-27), the owner of each residential unit must provide approved receptacles 'adequate and sufficient to contain all solid waste generated' and 'shall not maintain nor permit on the property, any unsanitary nuisance injurious to the public health.' A 'Can or Garbage Receptacle' is a steel, plastic, aluminum, or galvanized bin up to about 32 gallons or 50 pounds with a tight-fitting lid. Solid waste must be contained (not loose or blowing). Roll carts and container types are set by the franchised hauler for each service area.
Failure to provide adequate receptacles is a violation of the ordinance, prosecuted through code-enforcement procedures; special-magistrate fines up to $250/day (first) and $500/day (repeat) under FS 162.09.
