In unincorporated Tulare County, every occupied premises must have fly-tight, waterproof, covered garbage cans (or an approved fly-tight pit) that are emptied weekly. County Code section 4-03-1130 requires cans to be removed from the street within 24 hours after emptying, and they may not be left in a County or public right-of-way.
Tulare County's Management of Solid Waste ordinance (County Code Chapter 4-3) sets storage standards for trash containers in the unincorporated area. Under section 4-03-1130, it is unlawful to maintain or use any residence or business premises that is not provided with means for the sanitary disposal of all solid waste. The required system must consist of either a fly-tight garbage pit or the use of fly-tight, waterproof and covered garbage cans or receptacles expressly approved by the Solid Waste Director. The same section states that garbage cans and receptacles 'shall be emptied weekly,' must be removed from the street within 24 hours after emptying, and may not be placed in a County or other public right-of-way. All solid waste collected must be delivered to an approved solid waste disposal facility. The three-cart color system (gray trash, blue recycling, green organics) is set out in the county's SB 1383 article (sections 4-03-1635 and 4-03-1640): the gray container is for nonorganic solid waste only, the blue container for recyclables only, and the green container for source-separated organic waste only.
Improperly stored, uncovered, or street-stored containers can be cited as a violation of Chapter 4-3 and may also constitute visual blight under the Public Nuisance Ordinance (Ch. 4-1). Placing the wrong materials in a cart ('Prohibited Container Contaminants') is unlawful under sections 4-03-1635/1640 and may trigger a contamination processing fee. The County does not collect trash directly; containers and service are provided by your County-franchised hauler.
