Under the Residential Solid Waste Program (Code Ch. 23, Art. III), the county issues one garbage cart and one recycling cart to each customer; the carts remain county property. Customers are responsible for storing, cleaning and maintaining their carts in a sanitary condition, and may not deface a cart with paint, markers or other material. The county repairs or replaces carts damaged through normal use, or that are stolen or lost, but the customer pays for damage caused by intentional or grossly negligent conduct. Carts must not be loaded above 150 pounds or the rated lid capacity.
Cart misuse is a Code Ch. 23 violation enforced through Chapter 8 Code Enforcement proceedings; an uncontested first citation carries a reduced civil penalty of $150 ($300 for a repeat).
