Under Montana's County Noxious Weed Management Act, MCA 7-22-2116, every landowner must prevent state- and district-listed noxious weeds from propagating or seeding, either by following the county weed district's management program or maintaining a written weed-management agreement. The Yellowstone County Weed District administers control, inspections, and, where needed, abatement. Montana law does not impose a statewide lawn-height limit, and the unincorporated county generally sets no fixed grass-height number — ordinary tall grass is governed by city codes in Billings and Laurel. Uncontrolled noxious weeds, however, are enforceable countywide.
The weed district may issue a notice to control; if the owner fails, the district can abate the weeds and assess the costs as a lien against the property.
