Indio declares property containing weeds that create a fire hazard, harbor pests, or look unsightly to be a public nuisance under Chapter 12 of the Indio Municipal Code. The city's Code Enforcement Unit conducts weed abatement. The ordinance does not state a specific grass height; it uses condition-based standards.
Indio's weed rules come from Indio Municipal Code Chapter 12 (Ordinance No. 1809), which invokes California Government Code Sections 38771, 39501, 39502, and 39560-39561.5. Under Section 12.03's nuisance list, it is a public nuisance to maintain 'any property, premises, buildings, grounds or lots and their adjacent parking areas, sidewalks, or streets containing weeds which: (i) Bear wingy or downy seeds, or (ii) Constitute a menace to the public health, or (iii) Endanger the public safety by creating a fire hazard, or (iv) May harbor rats, vermin, ticks, or other disease carriers, or pests, or (v) Constitute an unsightly appearance, or (vi) Constitute an attractive nuisance, or (vii) Are otherwise noxious or dangerous.' The ordinance defines 'Weeds' to include 'Sagebrush, cactus, chaparral, poison oak, poison ivy, grass, stubble, brush, vegetation, and any other bush, shrub, plant, fungus, or other organic growth.' Notably, the city code is condition-based β it does not publish a numeric grass height. (Search summaries also note flowerbeds/gardens with overgrown or dead vegetation and trees/bushes encroaching onto neighbors as nuisance conditions.) The Code Enforcement Unit handles weed abatement; if an owner fails to clear declared weeds, the city can abate and bill the owner. In this desert climate, the fire-hazard prong is the most common trigger.
Indio PD Code Enforcement issues a notice to abate. If the owner does not voluntarily clear declared weeds, the city abates them and recovers the cost as a lien (Gov. Code 39560-39561.5). Failure to abate can be charged as an infraction (escalating $100/$200/$500) or a misdemeanor.
