NMC Chapter 9.50 (Loud and Unruly Gatherings) reaches any gathering of two or more persons on public or private property that substantially disturbs the quiet enjoyment of other property. The first Police response is a written warning. A second response at the same address within 12 months triggers civil penalties plus full reimbursement of Police service costs under NMC 1.16.050.
Chapter 9.50 was adopted to reduce repeat Police calls to loud parties without creating new criminal liability. NMC 9.50.030 defines a loud and unruly gathering as a gathering of two or more persons on public or private property in a manner that constitutes a substantial disturbance of the quiet enjoyment of public or private property. NMC 9.50.040-050 establish the two-step enforcement model: on a first response the officer in charge gives the responsible person written notice that any subsequent response within 12 months will be subject to citation. On a second or subsequent response, the responsible person is liable for civil penalties (set by Council resolution) and for full Police-service cost recovery under NMC 1.16.050, including officer time, vehicle and equipment costs, and any damage. Underage drinking is reached separately under the City's Minor Alcohol Offense / Loud Parties chapter (the City's social-host track), with a fine of up to $1,000 and possible jail time, plus half-hour billed Police cost recovery at $100 per officer responding. Generic noise disturbances also remain reachable under NMC 8.08.020 and California Penal Code 415(2).
Civil penalties under Chapter 9.50 are set by Council resolution and are imposed as administrative citations under NMC 1.20 with appeal rights under NMC 9.50.060. Cost-recovery billing under NMC 1.16.050 is separate and cumulative. The minor-alcohol track adds a fine up to $1,000, possible six-month jail term, and Police time billed at $100 per officer per half hour responding.
