Revised Ordinances of Honolulu Chapter 42 prohibits smoking, vaping, and tobacco use at all city and county beaches, parks, and adjacent sidewalks, building on Hawaiʻi's broad indoor smoking ban under HRS Chapter 328J.
Honolulu pioneered the nation's first city-wide smoke-free beach law in 2014, and ROH Chapter 42 now bans smoking, e-cigarettes, and other tobacco products at every Department of Parks and Recreation facility — including Waikīkī, Ala Moana, Hanauma Bay, Sandy Beach, and Magic Island — plus their parking lots, restrooms, and adjacent sidewalks. The ban complements HRS §328J prohibiting smoking in indoor workplaces, restaurants, bars, and within 20 feet of entrances. Cigarette butts are the most-littered item collected on Oʻahu beaches. Hawaiʻi also raised the tobacco purchase age to 21 ahead of federal law, under HRS §709-908.
First offenses carry a $100 fine; repeat violations escalate to $200 then $500. Park rangers and HPD officers issue citations, and littering with cigarette butts adds a separate citation under ROH Chapter 29.
