Open containers of alcohol on public streets, sidewalks, parks, and beaches are prohibited throughout Nassau County under town and village ordinances, and consuming alcohol in a parked vehicle on a public way also violates NY VTL Β§1227.
Nassau's three towns and many villages all prohibit open containers of alcoholic beverages in public places, including sidewalks, county parks, beaches, parking lots, and on transit. Possession of an open container in a vehicle on a public highway is a separate state offense under NY Vehicle and Traffic Law Β§1227. Public drunkenness alone is no longer a crime in New York, but related disorderly-conduct charges may apply. NCPD typically issues a summons. Permitted special-event areas, ticketed events, and licensed sidewalk cafes are exceptions. Beaches and parks during festivals may also have temporary alcohol permits.
Consuming alcohol or possessing an open container in public, or in a vehicle on a highway, can result in fines and criminal-court appearance tickets, with larger penalties for incidents tied to disorderly conduct.
