The 1992 Residential Lead-Based Paint Hazard Reduction Act (Title X) and 24 CFR Part 35 require disclosure and safe-work practices in pre-1978 rental and sale properties. EPA's RRP rule (40 CFR 745) requires certified renovators for jobs disturbing more than 6 square feet interior or 20 square feet exterior. Phoenix and Mesa have no separate lead-rental inspection. Section 8 housing requires HUD lead-paint inspections by certified risk assessors before occupancy.
Federal lead-disclosure violations under TSCA Section 1018 carry civil penalties up to $19,915 per violation plus triple damages to tenants. RRP non-certification fines reach $40,576 per day under EPA enforcement. ARS 33-1338 violations create tenant rescission rights.
