LAMC Β§161.352 plus Title 25 CCR Β§17920.10 require SCEP inspectors to flag deteriorated paint in rentals built before 1978 as a lead hazard. Owners must remediate using lead-safe work practices certified under EPA's Renovation, Repair and Painting Rule before re-occupancy.
California Health and Safety Code Β§17920.10 declares any deteriorated paint in a pre-1978 dwelling a substandard condition presumed to contain lead. During SCEP inspections, LAHD cites peeling, chipping, or chalking paint inside or outside the unit. Remediation must follow CDPH lead-safe practices and EPA RRP Rule (40 CFR Part 745): contained work areas, HEPA cleanup, and certified renovators. Disturbing more than six square feet interior or twenty square feet exterior triggers full RRP protocols. Owners must distribute the EPA pamphlet "Protect Your Family from Lead" and disclose known hazards under federal Β§1018 of the Residential Lead-Based Paint Hazard Reduction Act.
Uncorrected lead hazards trigger LAHD orders, REAP placement, civil fines, and tenant relocation assistance under LAMC Β§161.604. Federal disclosure failures expose owners to triple damages under 42 USC Β§4852d.
