Los Angeles rental habitability standards derive from multiple sources: the LAMC building, plumbing, electrical, and mechanical codes; the California Civil Code implied warranty of habitability (Civil Code Section 1941-1942.5); and the California Health and Safety Code. Key habitability requirements include: adequate heating capable of maintaining habitable temperatures; hot and cold running water; working plumbing and sewage systems; safe and functioning electrical systems with adequate outlets; freedom from rodent and pest infestations; weatherproof exterior including roof, walls, windows, and doors; working smoke and carbon monoxide detectors; adequate ventilation and natural light; safe and functioning fire escapes and exits; structurally sound floors, walls, and ceilings; and working locks on exterior doors. LAHD inspectors evaluate these standards during SCEP inspections and complaint inspections. California Civil Code 1942.4 prohibits landlords from collecting rent on units that have been cited by building inspectors as substandard. The Rent Escrow Account Program (REAP) provides an enforcement mechanism unique to LA: when serious habitability violations persist, tenants can pay reduced rent into a city-held escrow account.
Landlords who maintain substandard units face LAHD violation orders, REAP referral with rent reductions of up to 50%, and potential criminal prosecution. Under California Civil Code 1942.4, collecting rent on cited substandard units is prohibited. Tenants also have private remedies including repair-and-deduct (up to one month's rent) and lease termination.
