Required habitability standards include: heat maintained at 68°F when outdoor temperature falls below 55°F during daytime (6 AM-10 PM) and 62°F at night during heating season (October 1 through May 31); hot water at a minimum of 120°F supplied 24 hours a day year-round; working plumbing, electrical systems, and gas service; pest-free conditions with landlord responsible for extermination; functioning smoke and carbon monoxide detectors; adequate lighting in hallways and common areas; window guards in apartments with children under 10; lead-safe conditions in pre-1960 buildings with children under 6; working locks on entrance doors; and structural integrity of floors, walls, ceilings, and stairways. The warranty of habitability under NY Real Property Law §235-b gives tenants the right to a livable dwelling and cannot be waived in a lease. Tenants may pursue HP actions in Housing Court for persistent violations.
