ARS 36-1637 requires an approved smoke detector in every new residential housing unit at construction. For existing units, one is required if a sleeping area is remodeled with a Peoria permit. The statute splits rental duties: tenants keep alarms operable; the landlord must repair after written notice and notify the tenant of these duties. 'Approved' means a UL 217-listed device installed per NFPA 72. Peoria City Code Sec. 9-31 adopts the 2018 IFC, amended by Sec. 9-33 (Ord. 2021-13). The IFC/IRC require an alarm in each sleeping room, outside each sleeping area, and on each story including basements and habitable attics. New-construction alarms must be hardwired, interconnected, with battery backup. CO alarms are required with fuel-burning appliances or attached garages.
Failing to install approved smoke alarms in a new dwelling, in remodeled sleeping areas, or in the IFC/IRC-required locations violates state and city law. A landlord who does not repair an alarm after written tenant notice violates ARS 36-1637.
