Under 9 V.S.A. § 4467(a), a landlord may terminate for nonpayment of rent by actual notice of a termination date "at least 14 days after the date of the actual notice," and the tenant may avoid termination by paying the rent due before that date. For breach of a material lease term, § 4467(b)(1) requires actual notice given "at least 30 days prior to the termination date," while illegal drug activity or acts that threaten others' health or safety allow at least 14 days under § 4467(b)(2). After the notice expires and the tenant remains, the landlord must file an ejectment action; a sheriff may remove the tenant only under a court writ of possession.
No specific monetary penalty on the landlord. An eviction filed without the proper 14-day (nonpayment) or 30-day (for-cause) notice will not support an ejectment judgment, and self-help eviction without a court order is unlawful.
