New Yorks Good Cause Eviction Law, signed April 2024, automatically applies in New York City but requires opt-in adoption by local legislative action outside NYC. Suffolk County towns (Babylon, Brookhaven, Huntington, Islip, Smithtown, Riverhead, Southampton, East Hampton, Southold, Shelter Island) have not opted in. Evictions in Suffolk proceed under RPAPL Articles 7 and 7-A through district courts in Central Islip and the towns of the East End. Housing Stability and Tenant Protection Act of 2019 imposes statewide minimums: 30/60/90 day notice for nonrenewals or rent hikes over 5 percent based on tenancy length.
Improper self-help eviction (lockouts, utility shutoffs) is a Class A misdemeanor under RPAPL 768, fines up to 10,000 dollars per violation plus treble damages. Failure to give statutory notice voids the proceeding.
