Unincorporated Pima County does not maintain a rental registration or rental licensing program. Landlords must comply with the Arizona Residential Landlord and Tenant Act (ARS 33-1301 et seq.), which requires landlords to provide tenants with their name and address for service of process and to maintain properties in habitable condition. Landlords must also provide tenants with a signed copy of the lease, a move-in condition checklist, and information about the Arizona Residential Landlord and Tenant Act. Arizona requires landlords to collect and remit transaction privilege tax (TPT) on rental income -- residential rentals are subject to state TPT (currently 0.5 percent for residential) plus any applicable county and municipal taxes. The Arizona Department of Revenue administers TPT. Some incorporated cities within Pima County (like Tucson) may have separate business licensing requirements for landlords, but unincorporated county areas do not.
Since no registration is required, there are no penalties for failure to register. Failure to provide tenants with required disclosures under the Landlord and Tenant Act may result in tenant claims and lease voidability. Failure to collect and remit TPT on rental income results in penalties from the Arizona Department of Revenue.
