Under HRS section 521-44, Hawaii landlords may collect a security deposit not exceeding one month's rent and must return the deposit with itemized deductions within 14 days of tenancy termination.
The Hawaii Landlord-Tenant Code caps residential security deposits at one month's rent, separate from prepaid rent. Pet deposits up to one additional month's rent are allowed for non-service animals. Landlords must hold deposits in trust and, within 14 days after the tenant vacates and provides a forwarding address, return the balance with a written itemization of any deductions for unpaid rent or beyond-normal-wear damage. Failure to comply allows tenants to recover the full deposit plus statutory damages.
Withholding a security deposit without itemized notice within 14 days exposes the landlord to liability for the full deposit, plus damages up to triple the wrongfully withheld amount.
