Under ARS Section 33-1321, landlords cannot demand more than 1.5 months rent as security plus prepaid rent and a separate cleaning fee that must be labeled non-refundable in writing. Within 14 business days after termination and tenant move-out, the landlord must mail an itemized list of deductions and any refund to the tenants forwarding address. Tenants may request a joint move-out walkthrough. Wrongfully withheld deposits expose landlords to recovery of twice the withheld amount plus court costs. Maricopa Justice Courts handle disputes under $10,000.
Failure to return deposit or itemize within 14 business days exposes landlord to twice the wrongfully withheld amount under ARS 33-1321(D). Tenants file in the Maricopa Justice Court precinct where the rental sits.
