Ohio sets one of the more tenant-protective security-deposit frameworks in the Midwest, and Toledo enforces it through small-claims and Lucas County Common Pleas litigation. Under ORC 5321.16, the landlord must return the deposit within 30 days of termination of occupancy, or provide an itemized written list of deductions sent to a forwarding address the tenant supplied in writing. Deposits over $50 or one month's rent (whichever is greater) accrue 5% annual simple interest if the tenancy lasts six months or more. Deposits cannot lawfully be designated 'non-refundable' for ordinary wear and tear.
Wrongfully withholding any portion of the deposit subjects the landlord to double the wrongfully withheld amount and the tenant's reasonable attorney fees under ORC 5321.16(C). Tenants typically file in Toledo Municipal Court small-claims division.
