Toledo amended its Fair Housing Ordinance to prohibit landlord discrimination based on lawful source of income, including Section 8 Housing Choice Vouchers. Refusing to consider voucher-holders is a Toledo Municipal Code violation enforceable by the Fair Housing Center.
Federal Fair Housing law does not list source of income as a protected class, but Toledo's local ordinance does. A landlord with a unit at or below the LMHA-set Section 8 payment standard cannot lawfully refuse a voucher-holder solely because of the voucher. Acceptable screening criteria such as credit, prior eviction history, and income-to-rent ratio remain permissible if applied consistently. The Fair Housing Center of Toledo investigates complaints and refers matters to the city Department of Law or HUD. Class-based testing is regularly used to detect violations.
Stating 'no Section 8' in advertising, quoting different rents to voucher-holders, or refusing to complete LMHA paperwork can each constitute a Fair Housing violation, exposing the landlord to compensatory damages, civil penalties, and attorney fees.
