Plano landlords may legally refuse to accept Section 8 Housing Choice Vouchers or other government-assistance income. Texas Local Government Code Section 250.007 explicitly preempts cities from prohibiting source-of-income discrimination, blocking any future Plano ordinance.
Section 250.007 was enacted in 2015 specifically to block Austin and other Texas cities from extending fair-housing protection to voucher holders. Cities may not require landlords to consider Section 8, VASH, or other government rental subsidies as legitimate income. Plano therefore offers no local protection: a landlord may post no-vouchers-accepted listings without violating any city or state ordinance. Federal Fair Housing Act protections still cover race, religion, sex, national origin, familial status, and disability, and HUD has interpreted disability protection to sometimes reach voucher refusals when the refusal disparately impacts protected classes.
