W.S. 11-44-101 through 11-44-103 declare it the policy of Wyoming to conserve agricultural land and protect farm and ranch operations from nuisance suits arising from changed conditions in surrounding non-agricultural areas. An agricultural operation in existence for more than one year that does not substantially change is not a nuisance unless it is operated negligently, in violation of statute, or causes injury to public health. The statute applies to crop production, livestock, dairy, feedlots, and related processing activities. Plaintiffs bringing unsuccessful nuisance suits may be liable for the operator's costs and reasonable attorney fees.
Nuisance plaintiffs who fail to overcome the statutory shield may be ordered to pay defendant farms' attorney fees and costs; operations losing protection (negligent or unlawful conduct) face standard nuisance and regulatory remedies.
