Full Breakdown

Cheyenne City Code 9.20.020(C) makes it unlawful for anyone not authorized by law to possess, use, sell, barter, give away, or distribute marijuana anywhere in the city: the ordinance draws no line between public and private use. Cheyenne police can cite marijuana consumption in parks, streets, sidewalks, and other public spaces under this section. Wyoming has not legalized recreational marijuana, so this local ban runs alongside state drug law rather than filling a gap it left open; violators face the code's general misdemeanor penalty.

Violations & Fines

Violating Section 9.20.020 is a misdemeanor carrying a fine up to $750, up to six months in jail, or both, under the city's general penalty provision (Section 1.24.010).

Frequently Asked Questions

Is smoking marijuana in public illegal in Cheyenne?
Yes. Cheyenne City Code 9.20.020(C) bans marijuana possession and use anywhere in the city, so consuming it in a park, on a sidewalk, or on any public street violates the ordinance.
Does Wyoming's marijuana law override Cheyenne's ban?
No. Wyoming has not legalized recreational marijuana, so the state and city bans apply together. Cheyenne's ordinance is an independent citywide prohibition, not a gap-filler.
