FL ยง509.032 prohibits Apopka from limiting the duration or frequency of short-term rentals. No minimum or maximum night caps may be imposed by the city.
Florida Statute ยง509.032(7)(b) expressly preempts local regulation of the duration or frequency of short-term rentals. Apopka cannot impose minimum night stays, maximum annual rental nights, or cap the number of STRs in a neighborhood. HOAs, however, are private contractual entities and may impose stricter rental-duration rules under FL ยง720 (HOA Act) if properly adopted in the declaration. The 2023 SB 280 amendments retained the core duration preemption.
