Fort Wayne does not impose a cap on the number of nights a short-term rental can operate per year. Indiana Code 36-1-24 preempts outright bans, and Fort Wayne has not adopted a night-limit regulation.
Some cities nationally limit STR rentals to 90 or 180 nights per year to protect housing stock. Fort Wayne has not adopted such a cap. Under IC 36-1-24, Indiana cities can regulate STRs with reasonable rules on registration, safety, parking, and noise, but cannot prohibit them in residential zones. Whether an annual night cap would survive legal challenge under IC 36-1-24 remains untested in Indiana courts. Fort Wayne hosts can therefore operate year-round provided they maintain registration, pay applicable taxes, and comply with noise and safety rules. HOA covenants may still impose private night caps in subdivisions.
No city-level night cap violations apply. HOA enforcement actions are private civil matters.
