Alpine County sets no limit on how many nights a year a licensed rental may operate. It controls supply through density instead: Code Section 18.73.130 caps licensed rentals in the East Slope overlay district at thirty-five and bars a new license within 100 feet of another licensed rental. Denied applicants may join a waitlist.
Alpine County does not impose an annual night cap or rented-night maximum on licensed short-term rentals; a fully licensed rental may operate year-round. The County instead manages STR supply geographically. Section 18.73.130(A) provides that the number of licensed short-term rentals within the East Slope short-term rental overlay district may not exceed thirty-five. Section 18.73.130(B) prohibits a new license where the property is within one hundred feet (measured property boundary to property boundary) of a licensed rental in the residential neighborhood or residential estate zoning district, or within 100 feet of a dwelling unit on a licensed property in the agriculture zoning district. Properties with a valid registration or transient lodging home occupancy permit approved before March 17, 2020 were grandfathered from the 100-foot rule if they applied before July 1, 2021, and legal nonconforming uses may continue by maintaining an annual license, losing that status on a change of ownership, lapse, revocation, or cessation. These limits apply only to East Slope communities outside commercial zoning districts. When an applicant is denied because of the East Slope cap or the 100-foot buffer, Section 18.73.140 lets them join a county-maintained waitlist by submitting an application and a non-refundable waitlist fee; waitlisted owners get 30 days to complete the process when an opening arises, and the waitlist application is voided on a change of ownership.
There is no per-night cap to violate. However, operating without a license because an application was denied under the East Slope cap or the 100-foot buffer draws an immediate administrative fine up to $2,000 per day under Section 18.73.080(C). A property owner found renting without a valid license also forfeits any waitlist position and may not reapply for the waitlist for 12 months under Section 18.73.140(B).
