A change-of-use inspection by DFS is required before converting a single-family dwelling into a short-term rental that exceeds the Chapter 24 threshold. Town zoning may further restrict occupancy through density or family-definition rules: Burlington's Comprehensive Development Ordinance defines a 'family' for occupancy purposes and Burlington's Chapter 18 STR ordinance requires hosts to disclose maximum occupancy at registration. Vermont Department of Health rules under 18 V.S.A. Chapter 85 also require lodging-establishment licensure for any property offering three or more rental units or serving prepared food.
Operating a short-term rental above the 8-guest Chapter 24 self-certification threshold without a Vermont Division of Fire Safety change-of-use inspection or certificate of occupancy is enforceable under 20 V.S.A. Chapter 173 and the Vermont Fire and Building Safety Code, with administrative orders, penalties, and potential closure. Town zoning violations are enforceable under 24 V.S.A. Β§4451 (typically up to $200 per day per violation in Burlington, South Burlington, and other Chittenden County jurisdictions).
