Ocean Springs sets a Maximum Occupancy Determination for each residentially zoned STR during the pre-permit inspection rather than using a fixed per-bedroom formula. The figure is recorded on the permit and must be honored by the host and local property manager.
Under Ordinance No. 2015-11, Ocean Springs requires a floor plan and proposed maximum guest count with each Residentially Zoned STR application. The Planning Department then conducts an occupancy inspection (Mon-Thu, 10am) that produces a written Maximum Occupancy Determination, recorded in the Office Use Only block alongside Maximum Parking Spaces and the renewal date. The structure must meet fire and health codes as if commercially zoned: interlocked smoke detectors in every sleeping area, two means of egress per sleeping area, escape ladders for windows above 78 inches on two-story buildings, and Type 2A 10BC extinguishers within 75 feet. Residential STR permits are capped citywide at 115 in the City-Wide and Density zones; the Downtown Overlay District is uncapped.
Exceeding the Maximum Occupancy Determination, removing required smoke detectors, or failing reinspection ($25 per occurrence, three failures restart the application) can lead to permit revocation by the Board of Aldermen. Confirm fine amounts with Planning at 228-875-4415.
