State licensed vacation rentals follow FL Administrative Code 61C-1.004 occupancy guidelines based on bedroom count and life safety. PBC has not adopted stricter occupancy limits because FL Β§509.032(7)(b) preempts local caps below the 2-per-bedroom-plus-2 baseline. Operators must post DBPR license, emergency exits, and occupancy maximum inside the unit. Septic system capacity may further limit occupancy in unsewered areas (most common in western PBC unincorporated areas).
Exceeding posted occupancy: state license suspension by DBPR. Failure to post occupancy notice: $250 fine. Septic overload causing failure: health department citation plus repair costs $5,000 to $25,000.
