San Bernardino County regulates short-term rentals in its unincorporated areas through Development Code Chapter 84.28 (Short-Term Residential Rentals). Section 84.28.040 provides that an owner may use a single-family dwelling as a short-term rental 'only if such owner has a current valid short-term residential unit permit' and complies with the chapter. STRs are permitted only in the Mountain and Desert Regions (Section 84.28.010 and 84.28.020); 'short-term' means 30 days or less. A separate permit is required for each dwelling unit where more than one legal single-family dwelling or a duplex sits on a parcel. An accessory dwelling unit, guesthouse, or casita may be permitted as an STR when at least one unit on the parcel is owner-occupied, though that owner-occupancy requirement does not apply to parcels of two acres or greater. A maximum of two legal dwelling units per parcel may receive separate STR permits; individual apartments or condominiums within a multi-family project are not eligible. Application is made through the County's EZ Online Permitting (EZOP) system to County Land Use Services / Code Enforcement. The responsible department conducts an initial inspection to determine maximum occupancy and parking capacity and to verify code compliance (Section 84.28.030). Per the County STR program, a permit is valid for one year and must be renewed annually.
Advertising or operating an STR without a valid permit is a County Code violation. Code Enforcement may issue administrative citations escalating from $1,000 (first), to $5,000 (third). Operating without a permit can trigger a notice of violation and surrounding-property-owner notification, and the application may be denied or the permit suspended or revoked under Sections 84.28.090 and 84.28.100.
