No. Indiana law bars local units from limiting STRs to owner-occupied primary residences. Both owner-occupied and non-owner-occupied short-term rentals are protected; the county cannot require the host to live on-site.
Allen County has no primary-residence requirement, and state law would prohibit one. IC 36-1-24-8 makes an owner-occupied STR a permitted residential use, and IC 36-1-24-9 protects non-owner-occupied STRs, allowing a unit only to require a special exception or variance that cannot be applied to unreasonably restrict them. HEA 1210 (effective July 1, 2026) reinforces this by prohibiting local rules that ban STRs which are not owner-occupied primary residences. So an investor-owned, non-owner-occupied whole-house rental is allowed. Fort Wayne likewise cannot impose a blanket primary-residence-only rule.
Not applicable; there is no primary-residence mandate to violate. A local ordinance attempting to impose one would be preempted by IC 36-1-24 and HEA 1210.
