That rule applies only to ADUs and JADUs, not to detached single-family homes. Operators of any qualifying property must still register and collect the 10% surcharge under Chapter 150.
Because no primary-residence rule exists, there are no penalties for non-owner-occupied STRs in ordinary dwellings. Renting an ADU or JADU for under 30 days violates Government Code Section 65852.2 as implemented in local ADU standards and is enforced through county zoning code enforcement.
